Sorry, but that's not correct.
I'm speaking from experience, since I run SCCA Autocross with both an E46 330cic and E36 325i. When you press the DSC button, it is turned off until you stop the engine. It does not kick back in. For E46s that have DBC (Dynamic Braking Control) you hold the DSC button down for 5 seconds, then BOTH DSC and DBC are disabled.
If your car has DBC (I don't know what year that started) then that could be your problem.
The only thing that you cannot turn off is ABS, but there is no reason to turn that off.
