Anyone have any similar experience?

I have a 2004 325Ci Converible. The passenger side window dosn't fully go down and sticks up about 3/8". When it raises, it is about 1/4 too low and not flush with the closed rear window. There is certainly is bit more road noise from that side with the top up and windows closed (it is 90 degrres and muggy in NY these days).

It purchased it certified and it is still within warranty. The dealer I purchased it from said it is normal, yet I have seen a few others driving around and none have windows sticking up.

Personally, I feel that the dealer simply didn't want to incur the expense as they certified it so they are responsible for the repair. I have another appointment at a diffrent dealer to have it looked at. Should I keep the appointment or is it really normal. I think it needs a regulator or has a bad motor.

Here's the rest of the story....
My wife brought it in as I had to work.
xxxxxxBMW: "...hello Mrs. X, your car is ready"
Wife: Is it fixed?
xxxxxxBMW: No it is supposed to do that.

Sooo, I picked it up and asked the service rep to grab the keys to ANY convertible; if it also has a window that stick up and doesn't go all the way up in to the weather stripping like on the left side, I'll apologize and go away.

Well, the one they grabbed had a perfect window seating top and bottom.

I was told," well, we adjust the regulator and if it reaches its limit it needs a new regulator, but we don't like to do that.

I said, OK well, mine is not like the others, the regulator is obviously past its limit and I'd like a new regulator installed.

My appointment is next week. I have nothing but confidence that they'll get it correct next time.

Nice move. Glad they're going to resolve this (hopefully).

I can't belive that. That is such shoddy service - they make a big deal of a part worth a few bucks and less than an hours labour on the risk that you are not satisfied and don't use them again.

My opinion is that if it only costs a few hundred to fix, you do it, write off the expense and you're reducing your tax liability. Anything more (if its clearly your fault), then thats why you have public liability insurance.

Mugs.

This is definitely the dealer, not BMW NA. When I had issues with my 330 transmission, my dealer service rep told me that their attitude is "we'll replace ANYTHING that is even slightly questionable under warranty unless BMW NA specifically tells them not to." He went on to say that they do not abuse warranty, but since they get labor compensation from BMW NA for warranty work, it's additional revenue for them, and good work especially if the shop is slow.

Same reason most dealers crave Service Bulletin work. BMW pays; both the dealer and owner wins. Not to mention the great service rep. the dealer receives for prompt service and no haggle work performed on a warrantee vehicle…..
