Okay, I give - what's a sub-frame assembly, and what could he possibly find there? Evidence of something bigger going on? If so, like what??? VERY auto-UNsavvy.

I don't mean for this to sound unfriendly, but I would like to add that once the warranty is up, "recourse with BMW" and "buyer beware" don't apply. The car is over 6yrs old and has 80k on it. That comes out to roughly 13k a year, that is believe it or not, high mileage for the car. I attempted to trade my 04 330i into a dealer with 33k on it at 2 1/2yrs old, and the dealer said according to the black book the car has high mileage as these luxury cars are usually driven <10k a year. He advised me to try and sell it myself and offered assistance in doing so as it would be "better than any offer they would give me".
In the NYC area and I presume Boston to be the same, that car would sell for 10-14k depending on how good it looks and runs. Also Mass has some pretty bumpy roads, the constant speed bump feeling comparison is valid, I drove on the Mass turnpike before with a rental car and my do the roads need repaving. In Newton, the best suburb, even the yellow lines that divide the road are worn off, they heavily salt the roads up there. I would say as a result of age, high mileage, harsh winters, tons of salt, and bad roads, little by little the damage occurred.
I agree it sucks, I would not want to be stuck with the bill, but then again high mileage BMWs are not cheap to maintain. I personally don't think the E46 3 series is that durable of a vehicle.
