Got hit on the highway

I was coming home from the bar downtown, and pull up next to a 4dr Toyota the entrance to the highway to go home. We both pulled away from the light and started accelerating. About a 1/2 mile into the highway, he was 30 feet back from me. I was in the far left lane, him in the middle. I slowed down some and he came flying up next to me. At this point he started swerving at me like he was trying to hit me/run me off the road. His passengers were hanging out the window screaming at us. He did this twice, lost control and started spinning. We were probably going between 70-80mph, and he slid right in front of me. I slammed on the brakes and hit his drivers side with my front as he impacted his front into the 4 foot high jersey barrier going down the middle of the highway. I quickly stopped, but he bounced across four lanes to the right of the highway, hit that barrier, launched 4 feet into the air, slid back across the 4 lanes and finally stopped when he hit the middle barrier.

All in all, I lost my front bumper, damage to my passenger panel, and damage to my front right rim. Not to bad for an accident that started at 70mph. Their car was completely totalled and all 5 of them left in ambulances. The other driver was underage and drunk. The cops ticketed them for DUI and reckless driving, so they're completely at fault.

Praise to my car for stopping so quickly and staying in a straight line after they hit us. I'm sure if we had been in a different car, we would have lost control and went into a spin also. I'm just pissed my resale value just dropped so much for something that wasn't my fault.

What is it with NJ and people trying to kill each other on the expressways? I am glad to hear you are ok. Gotta love the Bimmers.

glad yer ok. and that suv got everything it deserved.. i just feel bad it met such a dumb owner.. either way, i hope those kids are ok too. it's nice to walk away from something so utterly dumb..

insist on oem parts for the repair no matter what they tell you!

Sorry to hear and I'm glad you are ok. I guess the good part about this is the damage isn't too bad and they will be paying for it. Good time to start looking at some aftermarket bumpers. [:)]

That's too bad snowcrash. Happy to hear you are all right and hope occupants in the SUV is doing fine as well. It is bad enough that the driver was underage and even worst he/she was driving drunk and thought it necessary to harass another motorist while using the vehicle as a weapon of choice.

It is sad that the drive never stopped to think about the responsibility he/she has to the passengers in the vehicle with him/her. I guess the age factor and driving while drinking come into play here, but it is sad to say many adults do the same thing. Some people never use their heads or common sense. I wonder who own the SUV? Someone is going to be paying a very big (possibly multiple) bill.

One can only hope he/she learns from this and in the future thinks before getting behind the wheel....

Oh I'd definitely go for OEM parts and have it done by the dealer. If his insurance company doesnt go for what YOU want, there's always this nifty little thing called small claims court [:)]

I'm sure they'd take your side!!

This happened in Charleston, South Carolina. The other car was 1991 Toyota 4dr (probably camry). Anyway, this kids insurance company is called 'Southern United', who specializes in, "in providing property, liability and full coverage to insureds with poor credit or driving history including DUI, at-fault accidents." Reading that statement, I figured the company was going to try and deny fault and not pay me.

I finally got in touch with the Southern United adjuster and he immediatly claimed responsibility for the accident. Right now, the estimate for damage is $9,850.27 They're also providing me with a rental car until mine is fix, and they are going to let me claim diminished value. I think they were just happy I don't have any medical injuries considering their driver was really, really at fault.

I agree. You should go for original BMW parts and ask the insurance company to pay for it. As you're officially not guilty, you could kick some serious ass in court.

Man, what a story! I guess my sad tale of being rear ended at 5 mph in stop and start traffic is nothing compared to that!!

You must have been freaked out when your car finally stopped... dagnabbit, I would have been in shock!

This is just one of the reasons we buy Bimmers, they're very safe cars and emergency handle incredibly well.

All I can say is "WOW!" Based on your description of what happened, I thought the damage would be waaayyyy worse. Your car did exactly what it was supposed to -- it kept you safe. I'm a first-time BMW owner, and am starting to see why they say once you buy one, you're hooked on the brand for life.

Hey -- ever think of taking "crash" out of your handle? Sortof kidding here. Glad you're alright and I'll send good thoughts your way in hopes your baby is back on the road in short order.
