In PA, I believe it IS a felony. Same with new york and a few other states.

If this happened to me, I would have just pulled over, dialed 911 on my cell phone and given the dispatcher this guy's license plate #. Tell them he just slammed into me and then took off, no one hurt, I'm going about my business but I need to file a report in case I need to file an insurance claim for damage or in case I develop symptoms of physical injury.

The police will most likely sympathize with you and then someone will get back to you in a few days and tell you what they found out. With a plate #, they'll nail the bastard and probably take a written statement from you.

As nice as it would feel to wring this guy's neck and bury your size 12 up his ass, you have to remember how the system works....

I'd claim I got a headache or neck ache or something. Anything to turn it into an injury accident as I report it to 911 on my cell phone. Injuries seem make the cops hurry up a little more.

No, in New York it is an Infraction when you strike another car and fail to stop assuming that there is no bodily injury (as I stated before).

New York Traffic Code, Hit & Run

It is a misdemeanor in Pennsylvania. It takes more than minor damage in either state to bring it to the level of a felony. I believe all states are about equal in their application of these types of laws.

get that guy!!! report it to the police. i had a hit and run in houston once. i followed the guy and nailed him in a neighborhood. there is no better feeling than this victory. and it is illegal.

I can't believe you wouldn't call the police immediately if you had a licence plate number. Who cares if there are witnesses. There is a dent on your car. You should have brought the charges. If I ddn't have my cell on me, I would have been on the next street corner calling 911. The police could have greated him at his house. Seems to me the police love hit and run, cuz there always more to why the perkson fled (driving without insurance...drugs maybe..who knows).

As far as the insurance, yeah, may not make sense to run that through them. The deductible and the subsequent increase in premiums may just make it a wash.

OUR BENZ's BAD LUCK!

Yesterday, I was using my wife's E320 to pick her up at work. My 5 yr old daughter was in the back seat sleeping. I was sitting on the stop light on the off ramp waiting to make a left on Western here in Los Angeles. All of a sudden I hear a large screech and bang. Hit my rear right side. As I look behind I see this car speeding on my side. All of a sudden my adrenalin pumps as I see he was pulling a hit and run. I notice to people inside the car. I follow him as he makes a right on Western and get's in a mexican restaurants parking lot. He almost hit other cars as he enters the lot. Realizing that I might end my life along with my daughter I decided to stop in the lot while the car proceeds off the lot and hits another car then off and gone they were. As I got out of the car everyone was asking me if I got the plates and It did not have any. As I slowly calm down, I find out that he hit another car before me totalling to 3 cars. A witness came over and points out that the car was dump a few blocks and 2 men have jump off and ran. I could not even remember what kind of car it was. It turns out to be an old model Mercury Cougar, No plates. Cops were acting like it's just another day in there neighborhood. This are most likely gang kids who just stole a car or out for there kind of fun. My wife was happy that we were OK but was very upset that her e320 has been hit. The car got scratch up too in the same area just a few months ago in her work parking lot but was paid off by the person. Insurance says it will cover it and I might even get my deductable back because of the situation. Deep inside I was happy I was not driving my BMW but felt as bad with what happen to our benz. I must admit the Benz was one tuff dude.

That really sucks...... How hard was the hit?(how much damage) Glad your daughter didn't get hurt. I would have reported it to the Police too, problem is he put a small impression (after the cleaning it's only visible from upclose) in the bumper and with my luck and the police they'd have told me its too late, I should have called at the scene, and to go home.

ouch izzyracer - but good no personal damage...

Makes me think of 2 stories that happend a while back. One - a friend stopped to visit me as he was passing through town. He was only dropping by for a minute - when a similar thing happend to his parked car - we went out to say goodbye and his car had been smashed up (near totaled I think) by some drunk joyriders weaving by - who caused similar destruction to a number of cars)...and the begining of a painful ordeal for my friend trying to get his car fixed up and being out of town - schedule disrupted and such...

The other story is concerning my (now) brother in law - when he was dating my sister. Bought a brand new NSX...in the first week someone backed out of a parking space into him as he was driving by...tore a rip (and more) down the whole side of the car...$7K damage!!...he was crushed of course...though I don;t think it affected his lease return or what not - down the road...(they fixed it so well no one could ever tell...)
