I think you've got to take it in for one more time for teh same reason before it's classified as a lemon. Look online for CA's lemon laws. Also, lemon law attorneys should be free since if they win, the manufacturer pays their bills.
New Century isn't doing anything particularly wrong. Most dealers in SoCal don't even give you loaners unless you bought the car from them AND you need to leave the car there for more than one day. And they don't even necessarily give you BMW loaners. A Kia is better than the Chevy Aveo (Daewoo) I got from Santa Monica BMW.
