And then, I wanted to [hatchet] the guy who did this to me...

I was stationary at a yield sign while on a roadtrip in Vancouver Canada. My parents in the car with me.

All of a sudden, WHAM! The car jolts forward, I realize I've been hit from behind. I get out and see it's a Dodge Ram, with a tow hitch on the front! The truck is barely dented, my car's trunk has detached and warped, the whole trunk caved in and sheetmetal over the rear right wheel arch is warped.

To cut a long story short (one that features a fit of hysterics seeing the damage, a 1 hour wait in the rain and then an ambulance ride to the hospital) .... the car is still in a body shop in Vancouver awaiting an estimate. Friends say it will be fixable, not totalled. I hope so, I can't afford a new car right now... Besides that car has sentimental value- I picked it up in Munich and enjoyed one of the best vacations I can remember.

I say, thank goodness we're all ok. (Minor whiplash injuries and a constant throbbing pain in my head aside). The airbag did not deploy obviously but the seatbelt pre-tensioner mechanism fires with a similar charge to airbags and so there were small particles and that strange burning smell in the air, and the airbag deployed light came on. The hazards came on, doors unlocked as promised by all the safety spiel in the brochures.

Alas, my car will no doubt never be the same. One more reason a lease was a wise idea. 2 years left and I can walk away from it and not have to worry about selling a car that has two different halves welded together....

Glad you're ok, at least that Dodge got his bumper bashed good for doing that to your bimmer... Don't worry about the damage they can fix that, the e46 has 3 separate frames (the rear, the middle cage, and the front). If the side arch sheet metal is warped, it's no big deal they can replace that one piece on both sides if necessary. Then they can give you a new trunk, and a bumper along with whatever other parts are needed. Go to the local BMW dealer and get it fixed at their shop it will drive 100% the same. There isn't any visible frame damage, the 3er is a VERY strong car. Goodluck, and I know what it feels like to get rearended with a brandnew car...

I've switched photo servers from yahoo to shutterfly- hopefully they wont dissapear... don't quite know why that happens..

anyway.. as for fixing the car at a BMW Dealer's shop- the insurance company in Canada is sending it to one of their shops. They told me I cannot have the car trucked over the border as it's against the law for canadian towtrucks to bring cars over. Who writes these laws anyway?!?!?

I am getting an estimate from Rich City body shop in Vancouver and I don't really know anything about the place except that it's recommended by the guy's insurance company ICBC...I guess I'm trusting they are good and just hoping for the best. So here's a question- should I be more picky about the body shop? Like call a Vancouver BMW dealer and get a recommendation? Or should it just be ok to go with their shop?

GO TO VANCOUVER BMW. DO NOT LET A NON-FACTORY BMW REPAIR FACILITY TOUCH YOUR CAR.

When you go to return your lease, and they inspect the car (they will know even the smallest amount of body work)...they are going to find out the car was not repaired at an authorised North American BMW dealership. You do not want to be responsible for anything they might deem "not to factory standards".

Do not let some ICBC insurance company choose who will do the repairs. Their customer hit you, and heavily damaged a newer BMW. You call the shots, and ONLY accept an authorised BMW dealer. Trust me!!!!!

Whatever you do, do NOT let that insurance companys bodyshop fix or touch that car. Tell them you want it fixed at Vancouver BMW and if they don't fix it and pay in full, you're gonna sue them for it. BMW requires a special frame machine where the wheels get taken off and the chasis is bolted down to the machine, it takes about 4 hours. You should call your insurance, and report it to them and let them handle it, pay for the repairs and then go get the check from the other guys insurance. NEVER let an insurance company (especially the other guys;enemy) shaft you around... Goodluck again.

Ok! Good advice. I'm sure ICBC will cooperate- I will also call BMW tomorrow and get info on the lease return criteria for repairs. ... what else....

yes!! BMW customer service-- I poop on you! At the time of the accident, I called Roadside assistance for a tow truck and asked the operator about any other benefits they could extend to me. When I told her I was 150 miles from home, she said I qualified for "Trip Interruption Benefits"- Up to $750 to spend on incendentals. So of course my family and I got out of hospital around 9pm and I was not about to rent a car and drive it back to Seattle (The accident happened as we were leaving the city to come back after our roadtrip!!) So I got a hotel room for us.

So when I got back to Seattle and called BMW Roadside assistance to get details on where to send my bill, I was shocked to hear "Oh, you were given the wrong information, TIB is for Breakdowns only, not accidents... sorry we can't help you!" so I called BMW corporate and was told, Roadside Assistance is handled by a 3rd party and has nothing to do with BMW so we can't help you.

I was like, "DUDE! It's B-M-W Roadside Assistance- your Frickin' NAME is on it, dude!! It has EVERYTHING to do with you!! If an operator gave me the wrong information, you are accountable for poor training, and you should honor the information I was lead to believe at least, it's called customer service!!"

I hope the insurance will pay for the hotel. BMW's rep said he would call the Roadside assistance company to try to resolve the matter, and of course I never got a call back. Kick you when you're down... BMW.

I have to admit I was never impressed with Roadside Assistance.

But, I'm just glad everybody is okay. Looks pretty nasty in the back there, but I'm sure they'll be able to fix that easily. I would think a hit on the front would be much worse.

So how forceful are the seat belt tensioners? Was it enough to leave bruses?

Sorry to hear about this, I'm glad everyone's OK. The pictures are a testimony to BMW strength and safety. Believe it or not, I passed a rear ender accident yesterday that involved a Dodge Ram and a Dodge Neon. Your bimmer looks good compared to the Neon. The bumper of the Neon was level with what used to be the rear window! The car was certainly totalled. The damage to the Ram was about the same as your picture.

Stay on the insurance company and get it fixed through a BMW dealer, get your agent to apply pressure if necessary.

I gasped when I saw those pics. So sorry for your nightmare. Glad all are OK.

I hate most customer service of any kind. It's like you have to ask 5 times and talk to every supervisor on the planet to be sure of anything you are told. And even then you cannot be sure. Damn BMW errrr I mean Third Party Roadside Resistance.

Bmw 325i 7803 is spot on. The damaged parts will be perfectly replaced at the official dealer and the car will handle, as well as look like new. No worries.

I was lightly hit by a huge truck on my rear left side and my car was only three months old! I absolutely know how you feel. A huge metal part plus the rear left door got replaced, and God knows, it took long! It took long for a reason though. They did a terrific job.

Guys, there's nothing shocking about such an accident. It's the most common type: getting hit from behind. No one is seriously injured, the car isn't totalled, the insurance will pay for it and you'll forget about it in 3 months.

Again, go to the official dealer and let only people authorised and equipped by BMW handle the case and no one else.

You have to yield meaning you have to yield to oncoming traffic. If traffic is busy you will eventually have to stop. If traffic was busy he did the right thing. The oncoming traffic has the right-of-way.....

A hit on the front would be about the same as a hit on the rear, only with more $$$$ damage but less injury. (no whiplash) The front isnt as complicated as it seems, so long as the engine doesn't impact anything all they'd need to do is replace the lights, belts, hoses, radiator (maybe the suspension components and the steering) and he'd be good to go. Theres just a bumper, impact absorbers, two frame pieces which are hooked onto the chasis and two sheet metal arches for the side pieces. BMW builds one simple car, they engineered it to be safe and easy to repair to 100%. (the only problem accident I think would be a high impact T-bone, I wonder how they'd go about fixing that???) However, after looking at the e90's engine bay It was depressing. I guess time and experience will create expert e90 collision techs...

Oh and just to add on to what I said in the previous post about letting BMW fix it, be sure to let them TAKE THEIR TIME and be patient. You'll be greatful after it's all said and done, I can only imagine what rushed work looks like or the quality of repairs from pressured-pissed-off techs...

Traffic laws (when I was a kid some 20+ years ago while learning to drive [rolleyes] ) state that at a yield sign, you must come to a complete stop, check the state of traffic and, if clear, proceed into the road.

That "complete stop" caused me to fail my first driver's test in Canada (where I'm from) as I was rolling at about 10 kph and a car was about 200m in the distance and I sped up, clearly able to get in front of it and into the road safely at the speed limit of that road. [80?] I will never forget that day nor the driving test instructor who sat in attendance. [bash]

In any case, he did the right thing and the fact that he got rear-ended won't change that. Crying shame the guy behind him was snoozing. Must have not gotten the Bluetooth option on his Dodge Ram! [hihi]
