They know when and where defective trans were manufactured, which production runs are involved, VIN #'s, dealerships and yes, they know who bought them, the lowly guy at the bottom you and me. There is no need for discussion, argument or interpretation. To suggest anything other is disingenuous.

One must first come clean and acknowledge the defect. BMW "as of date ../../2004 transmissions with revision level "X" have been tested and are confirmed defect free". Put that information in writing make the purchasers of defective trans whole by replacing them. Begin to repair brand loyalty by ensuring quality control measures. Regardless, this is all fools folly as NHTSA has the case and BMW will comply with another "voluntary recall". And yes, it will be in writing. BMWNA will boast all of their recalls have been voluntary.[thumb]

And again I say you are dreaming. Not that it wouldn't be the right thing to do. Not that I wouldn't want to see the same thing in consideration of the fact that I paid $40K for what is supposed to be one of the premiere cars in the world. But it won't happen. The recall ... probably. But a public statement to the detail that you are asking? When have you ever seen an automobile manufacturer do that?

What you are asking for is a normal part of a recall notice (or TSB) and is different from what Importer Of Record is asking for: "One must first come clean and acknowledge the defect. BMW "as of date ../../2004 transmissions with revision level "X" have been tested and are confirmed defect free". Put that information in writing...". What I am saying is don't expect a separate public announcement from BMW acknowledging a defect and stating what cars with what tranny revision levels are ok and which are not. I've never seen that happen with any auto manufacturer.

Yes.

The attorney I consulted recommended to use the Pennsylvania Lemon Law. Pennsylvania requires 3 failed repair attempts or 30 days of shop time to qualify. This is the second replacement transmission, plus failed software patches, for a total of 2 failed and one apparently successful repair. If this transmission fails, 3 strikes for BMW, the lemon law can be invoked.

What is the status of the investigation? When will they announce a recall?

[rofl] The "Investigation" is just a complaint filed by a single owner to the NHTSA, which they are obligated to follow up on. It will probably take a long time, and the odds are that nothing will be done. If you look at the volume of NHTSA complaints, and the percentage of them that actually result in some sort of action, I'd guess the percentage is very small. In other words, don't hold your breath! [rolleyes] If you have a problem with your car, print off the TSB, take it to your service department, and have them order a new transmission to get your car fixed.

NHTSA is mandated to research every complaint. Investigations are only opened when a complaint is substantiated. Most investigations result in action. Given this is a safety related issue the governmental agency moves swiftly to protect its citizens.

After learning of this well-known defect since 2002, some have opted to do whatever is necessary to keep this from happening to the next person. I argue by doing this "If you have a problem with your car, print off the TSB, take it to your service department, and have them order a new transmission to get your car fixed. " you offer nothing toward the resolution of this defect nor do you do anything to keep BMW from acting irresponsibly in the future. The choice seems obvious.[wave]

This place it like a car wreck, I should just keep on driving but I can't help but slow down and rubberneck at the spectacle!! [rofl] I think I've read through every thread on this site related to the "sliptonic" issue, and at this point I have seen hundreds of posts from the angry mob who want to string BMW up.......... and absolutely NO action of any consequence! It's hillarious!!!! [:D]
