I read into it a little and I think it was that they can recover the fees from the manufacturer if they win. I was also under the impression it was contingent when I first looked into it so I'll have to talk to them about it. I beleive the $600 is because they can't recover anything if the manufacture settles out of court, hence, no fees they can recover so a retainer makes business sense.

Well, give some thought to remedy. Most states laws give the manufacturer the option to replace the vehicle with another....that will not get you in an X3. I don't mean to be mean, but you may want to give some thought to how this may appear opportunistic. I realize the headlights have caused you much pain. But to demand a new car becasue of it?!? Are you throwing the baby out with the bath water?

I wasn't going to say it but I agree. Headlights aren't a "little thing", BUT since they didn't burn out at the same time - and the dealer sounds like they replaced it promptly as they were supposed to, I don't see how there is a case. I thought the lemon law was if the same thing went wrong more than three times - or if the product is overall defective. I'm not quite sure how someone can expect a car with an unbelieveable amount of parts to not have any problems. Even new ferrari's have a warranty for a reason. I think he also called it a dealth trap, but it's probably the overall safest vehicle on the road today next to volvo's. I doubt the headlight problem will happen again, and I hope you wait to see if you have any more headlight problems before taking legal action. You'll just end up costing the government more money for a new car with new problems. You aren't going to buy a car from anyone that has no problems.

The first vist was to Brecht in Escondido, Ca. The I took it to Savage in Ontario, Ca. Then it was at Riverside BMW once, then twice.

The headlights are working now, but for how long is the question? I find it odd that both lights failed within months of each other. If BMW is serious, they will get us out of this car and into something different.

When all this was unfolding last time, I talked to a salesman at Riverside about trading in the car for an X3, but I don't feel like taking $4k upside down on the lease and puting it into the new payment. If we are driving a rolling wreck waiting to happen, why should we have to take in the shorts is my position....

I hope BMW NA will take care of you! Thats just wrong and not to mention extremely dangerous at night.

BMW NA customer service just plain [thumbd] in my opinion.

Here's the senario......


You are driving home after dark and all of the sudden you loose BOTH head lights at 50 mph. Since you don't normanlly drive with the fog lights on you now have no vision of the road, and since you live in the desert, there are no street lights and no other cars around you for light.

Or, your cruising down the road and the CHP pulls you over, giving you a ticket for a problem that HAS been addressed over and over again. Do you really feel this is a minor problem not worthy of a lawfull review? After all, the vehicle has demonstrated an inability to remain legally equiped over and over again.

Welcome to MY car. It is dangerous. The dealer HAS " fixed " it 4 times now. Do you honestly feel I should just keep going back again and again? When is enough enough? When my wife hits a joshua tree an totals the car, or flips it because the right side catches a rain rut off the pavement and it rolls?


If BMW takes the car back, we want what is outlined in the Beverly - Song act. I am not looking to screw anyone over, but the law is in place for cars like this. If BMW fails to act, so be it. But one way or another, the issue will be settled.


You may see this as an inconvience for city dwelers, but I see it as BMW screwing with our lives.

I think you should call up BMW NA and explain your problem to them. I agree that this is straight up dangerous for you and the drivers around you. Tell BMW NA that the dealership has already "fixed" it 4 times and you no longer have the patience for another "attempt". It is unfortunate that this happened to you, because I am sure you would be enjoying every minute spent with your car had you been problem-free from the start.

some times people get too caught up in brand loyalty and think everything is ok or that is just excellent because its a certain brand. you should read some of the post on 'sliptronics' a while back! haha

anyways if BMW can fix it .. great!
but if they can't, then they should def. step up and make it right!

I've called BMW twice now and I am waiting for a return call. If nothing by the end of the week, (as I know they are busy), then I will pay the retainer and proceed forward.

I found out yesterday BMW Customer Service transfered my case to BMW Corporate for their review. I guess they don't have the authority do anything.......

Man I'm sorry to here about the situation you are facing with this car. Let's not over look the fact that EVERY car company has their share of problems. Having said that this problem should have already been addressed and fixed right the first time. I hope this does not make you want to leave BMW.

Monday, BMWNA Ordered a service on the car to "Take a look". It went in Tuesday.
Since the entire lighting system was just replaced, everything checked fine for them.

I have a year left on the lease so I guess we'll see what happens.

I assume after BMWNA gets the service records from this "review" they will contact me, but if history shows true, I'll wait a month without any contact. Then, I'll call and be forwarded to a voice mail. I may or may not get a call back depending on the alignment of the planets and the average humidity at both the Poles......

Well.....Suprise-suprise.......


On the way home tonight, the left light started a very distinct fluttering like there was a voltage problem........POOF!! The left xenon is out.........Again.


Someone get me a can full of gas and a hand full of matches and meet me in the open field!! I want to torch this POS.......

Man, that is INSANE. I'm sure you're at the required 3 fixed now to invoke the lemon law. Tell them you've had it! That's just crazy.

It has been in the shop 4 times now already .......4 TIMES!! This would be the 5th time if I were to take it in.

It's not going to the dealer again....It's going to my new attorney's desk. Monday I'll pay the retainer..........I'm so fuming mad it's making my ears ring!


And to top it off, all my calls and conversations with BMW NA, gave me the distinct impression that they didn't give 2 schits about my problem! I will say again...... I had a better car, with better service through Saturn. A far as I'm concerned, I'm taking BMW NA for the full ride on the Beverly - Song Warranty Act choo-choo train........


This is just rediculous.......
