Updated today......
We went through the pretrial stuff, and BMW said go pound sand......Her's the jist of it:
I called BMW NA today to talk to the rep who handled our case. I asked, " What is BMW going to do with this car?"
Her answer was simple, " Sir, your car is under warranty, so go get it fixed." I said, " BMW has had the car 4 different times for the same problem. Our headlights don't work. Our car has again failed and now we only have one headlight working."
She said, " We will not buy the car back." I said, " According to the beveryly-song warranty act, this car is unrepairable, and your violating tha act."
With that, the conversation was ended by her.
Bottom line, is that BMW is MAKING us drive a car which is violation the California vehicle code, and is a major safety hazard. They feel a consumer should have their car in the shop over and over and over because it's under warranty and that they have done no wrong in failing to repair a car they have proven cannot be fixed.
I got the clear view that BMW does not stand behind their cars, and so thus, we are now officially sueing BMW NA for violation of the lemon law. It's sad they they don't give a rats ass about us, and I will now say that I can never own another BMW and will discourage anybody whom I know from buying one.
Not only all this, but our drivers side window is now clicking and fails to go up all the way some times, like it's off track or something............BMW's are now just Euro crap to me....
