To anyone who "matters" (aka. Judge/Jury), I suspect it would only be considered fraud if BMW was refusing to fix it. Since they're fixing it, it's not like they sold you a faulty product and then said "Too bad, sucker!".

Until the system is repaired at your BMW center, it may not be available for use below a temperature of 32ºF. I live in S. California and it will hardly if not go below that temperature, but if I take a trip up north or the East coast that can poss a problem. Up until my one year service is over anyway. Well, better tell my service man while it is still in the shop.

I'm quoting my own heheh!

I miss my baby 330i. I went ahead and called LB BMW and service rep said the car is ready. I said, really? Took the car in Monday and now it is ready with the replaced transmission. Am I dreaming? Will see how it is. I'll place an update as soon as I confirm the fix.

Situation
Customer may complain of delayed P to D engagement (2 to 30 seconds) during the first cold start in the morning
Cause
Unfavorable tolerances of C1 clutch housing causing internal transmission pressure leakafter extended (overnight) parking
Correction
ON A CUSTOMER COMPLAINT BASIS ONLY, after verifying the above mentioned situation REPLACE THE TRANSMISSION WITH THE IMPROVED UNIT

Nope, still wrong!! WHY would they do it!!!!! They sell them with 4 year warranties, including the cars on LEASE. They would not put a faulty transmission, something that takes 6 hours (they could be using on other cars) of labor to fix (at the dealer/bmwna's expense).

Do you understand how car companies operate? It sounds like you bought the car expecting it to be 100% perfect...if it was, then why would they give you a warranty WITH the price of the car?

I do not appreciate you saying "don't like the delay". It is very scary to expect to go forward and not move.

Got the car yesterday and everything looks great. Dealer was awesome even though they were busy as hell. This beast is really way diifferent from the 325 loaner I drove. It made me appreciate my car even more. Don't get me wrong I tought 325's were not bad too. I carpooled with my wife on her NIB Benz E320 today so that the Beemer can settle down in the garage and I can see tomorrow if the delay is gone. (crossing my fingers). I will post my invoice on next update.

I also take your words seriously. Let us know how things work out. Just be thankful knowing people are no longer saying "patch your clutch" or "upgrade the software".

The clutch pack fix and the tranny swap are the SAME THING. What does it take to get this through to you people... It has been explained numerous times by a BMW rep and by many people on the board who have spoken to BMW and their service advisors. Only diff is clutch pack is fixed @ factory (instead of @ dealership by BMW Tech) and they swap the part @ the dealership... Are you guys really that dense? [bash]

The only thing you guys are doing is causing mass hysteria by posting lies.

Why don't you just stop and please leave my thread alone. If you must have your clutch fit every couple of days start your own thread call it "Oh how I love my clutch patch" You sound like my daughter who wont give up. The only evidence I have seen is the TSB and it says not a word about a clutch.

Then why was I offered the clutch patch by my dealer also ... who told me that it's the same thing? That's enough evidence for me. I would suggest that it is YOU and people like Car_54 that won't give up.

1. Nobody has EVER said that a software patch was a single, final fix. Software patches were tested last fall and quickly proven that it WOULD NOT fix the problem.

2. When the work is performed as per the TIS, THE SOFTWARE WILL BE UPGRADED IF IT IS NOT AT THE CURRENT REVISION.

You are once again providing inaccurate information as a byproduct your condescending attitude and lack of knowledge about software patches.

relax everyone. No one here really knows who knows what. Or what really are the facts including me. All I know is this. I experience an anomally with my brand new 330i which at first I did not mind because I did not think it was a big deal. I come to BMW board to learn more about my car and BMW in general. Come to find the P to D delay problem which is reflective of what I have experience. I panic and was upset that they have to change the tranny as a solution. I said Why, Why, Why, Why, Why like most of us here. Complaint to BMW NA, to my salesman and to everyone I can talk too. After learning more of the situation and weighing all things. I come to this conclusion. BMW does its best to make us happy... They might be the ultimate driving machine but they are not perfect, but they will doo there best to correct things. It may not necessarily to our process but to theres. After all they are a business and has to make money. they found a problem and they put out a solution and it works. I was heart broken, but BMW took care of it in 4 days and they did not leave me hanging. It restored my confidence back in german engineering. I got the car back just last Thursday. Kept the car garage til' early this morning. Started it. backed it off. put it on drive and walah... it's fix. I ran from San Pedro to Aliso Viejo, CA through 405 south and I swear to my God this car feels much better. shift is fast, and the tranny feels solid. Thank you BMW of Long Beach. So, where is my SMG paddle wheel conversion?

My experience was similar, but I guess I'm more laissez faire about it all.... my wife said "Hey, when I back out of the driveway the car takes a while before it starts moving". So I drove it and thought "Son of a $#%#, that's not good!". I found this forum and others, and discovered this known issue. I printed out the TSB, took it to the dealer and said "This is exactly what's wrong with my car". The dealer ordered a new tranny, put it in a couple weeks ago, and now it works great! Pretty simple and easy. I could be all bent out of shape about having to do this with a brand new car, but all I'd end up doing is raising my blood pressure for something that in the end really doesn't matter. So I'll just be happy with the result, and move on. [wiggle]

Theres a 30 some page thread that kirby started -- has more information from everyone than your dealers have. This thread (the one you're reading right now) is pointless. It's spam, becuase the board is littered with "sliptronic" threads.
